Late yesterday the HMRC updated its guidance again on the Coronavirus Job Retention Scheme and also updated other guidance documents.

The main change is that the guidance clarifies that employees who are union or non union representatives can undertake duties and activities for the purpose of individual or collective representation whilst they are furloughed, as long as they don’t provide services or generate revenue for or on behalf of the employer.

That is significant in confirming that (suspected but not confirmed) redundancy consultations can progress with employees on furlough and by analogy that representing a colleague at grievance or disciplinary meetings is also permissible on furlough.

Members will also note that the guidance is now explicit in saying that employees who are unable to work because of caring responsibilities, or because they are looking after children, can also be furloughed.
